Terms of Service

The agreement between us, plainly stated.

These Terms govern access to Lucent — the platform, the Lucent Residency program, and every home we operate. They are written to be read. Where a clause is binding, it is plainly marked.

The short version

Lucent operates a private residency program — Members occupy our properties under a personal, revocable license. Stays are not hotel reservations and not tenancies. Disputes are resolved by binding arbitration. The detail below is what you are agreeing to.

I.Agreement

The agreement.

By accessing or using Lucent — the website, the member portal, any mobile experience we publish, or any Property we operate — you agree to these Terms and to our Privacy Notice. If you do not agree, do not use Lucent.

These Terms form a binding contract between you and Lucent Property Group, Inc. You must be at least 18 years old and legally able to enter into a contract.

II.Definitions

The terms used in these Terms.

  • Lucent

    Lucent Property Group, Inc., and its affiliates and subsidiaries.

  • Platform

    Lucent’s websites, applications, member portals, and connected services — including this site and any successor surfaces.

  • Property Owner

    The legal owner of a Property listed or operated through Lucent — which may be Lucent itself or a third party whose Property Lucent manages under a written agreement.

  • Property

    A residence offered through Lucent for occupancy under the Lucent Residency program.

  • Member

    A person admitted to the Lucent Residency program. Membership is granted by Lucent in its sole discretion.

  • Stay

    A single, time-limited, revocable personal license granted to a Member to occupy a Property under these Terms and the applicable Residency Agreement.

  • Residency Agreement

    The per-Property occupancy license signed at the time of a Stay, which incorporates these Terms by reference.

III.The Residency

The Lucent Residency program.

Lucent operates a private membership program — the Lucent Residency. Membership is granted by Lucent in its sole discretion, is personal and non-transferable, and may be suspended or revoked at any time for breach of these Terms, conduct that puts a Property or its neighbors at risk, or any other reason permitted by law.

Stays are a benefit of Membership. Only Members in good standing may book Stays. Lucent may publish additional rules for Members from time to time; those rules form part of these Terms when posted.

IV.Stays

Stays are licenses — not leases, not lodging.

This section is fundamental. A Stay is a revocable, personal, non-exclusive license granted by the Property Owner to a Member to occupy a Property for a stated period. A Stay is not:

  • A lease, sublease, or tenancy under any landlord-tenant statute.
  • A hotel, motel, inn, or transient-lodging accommodation under any hospitality or innkeeper law.
  • A vacation rental, short-term rental, or short-term lodging service as those terms are used in any local ordinance.
  • A timeshare, fractional interest, or any form of real-property interest.

The Member acquires no possessory interest, no right of habitation beyond the licensed period, and no right to invite or sublicense others except as expressly permitted by the Residency Agreement. The Property Owner retains full possession at all times and may revoke the license for breach, safety, or compliance reasons. Eviction-style proceedings do not apply because no tenancy is created.

Lucent and the Property Owner classify the relationship as a private membership-based residency license. The Member agrees to that classification and waives, to the maximum extent permitted by law, the right to claim that any Stay constitutes a tenancy or transient lodging.

V.Reservations

Reservations & payment.

A reservation is confirmed only when (a) a Residency Agreement is signed by the Member and (b) full payment is processed by Stripe. Until both have happened, no license is granted and the Property remains unreserved.

Pricing is stated as a per-Stay membership and residency fee. By submitting payment information, you authorize Lucent (through Stripe) to charge the stated fee, applicable taxes, any refundable security deposit, and any post-Stay damages or fees disclosed in the Residency Agreement. All payments are non-refundable except as expressly provided in the Residency Agreement or these Terms.

Lucent does not store full card numbers. Payment data is held by Stripe under its own privacy and security terms.

VI.Cancellation

Cancellation, changes, and force majeure.

Cancellation terms are stated in the Residency Agreement and apply to each Stay individually. In addition, Lucent may cancel, shorten, or modify a Stay at any time if:

  • The Property becomes uninhabitable or unsafe.
  • A regulatory authority restricts or prohibits the Stay or the Property's use.
  • An event of force majeure prevents performance — including natural disaster, pandemic, civil unrest, governmental action, or utility failure outside Lucent's control.
  • Lucent reasonably determines, in its sole discretion, that hosting the Stay would violate applicable law or these Terms.

In any of these cases, the Member's sole remedy is a refund of fees paid for the unused portion of the Stay. Lucent will not be liable for travel, relocation, or consequential costs.

VII.Compliance

Member representations & local-law compliance.

You represent and warrant, for every Stay and every visit to the Platform, that:

  • You are at least 18 and legally capable of forming a binding contract.
  • All information you provide — to apply, to book, to verify identity — is true, current, and complete.
  • You will comply with all laws, ordinances, and Property rules — including occupancy limits, noise ordinances, parking restrictions, and any registrations, taxes, or notifications triggered by your use of the Property.
  • You will not use the Property for any illegal purpose, commercial sublicensing, paid event hosting, filming or photography for commercial use, or activity that creates a nuisance to neighbors.
  • You are not on any government sanctions list and you are not booking on behalf of anyone who is.

You agree that any regulatory, tax, or civil consequence arising from your use of the Property is your sole responsibility, and that you will indemnify Lucent for any such consequence as set out in §XIV.

VIII.Conduct

Conduct & house rules.

Each Property has rules disclosed in the Residency Agreement: occupancy caps, quiet hours, no-smoking and no-party policies, pet policies, parking, and access procedures. Material breach is grounds for immediate license revocation without refund, removal from the Property, and suspension or termination of Membership.

You are responsible for the conduct of every person you bring to the Property, including any guests, family members, or service providers.

IX.Damages

Property condition & damages.

Members are responsible for any damage to the Property or its contents caused during their Stay beyond ordinary wear and tear, including damage caused by anyone they bring. Damages are first applied against the security deposit and may be charged to the Member's payment method as authorized in §V, with an itemized statement provided.

The Member agrees to report any damage promptly upon discovery. Concealment of damage is a separate breach of these Terms.

X.Partners

Owner & partner terms.

Property Owners, brokerage partners, sales agents, and service partners are subject to their respective written agreements with Lucent — the Owner Agreement, Brokerage Partner Agreement, Sales Agent Agreement, and Service Partner Agreement, as applicable. Where those agreements conflict with these Terms for the audience they cover, the dedicated agreement controls.

Lucent acts in those relationships as the operator and contracting party. Lucent does not act as a general agent or fiduciary for any Property Owner except where a written management agreement expressly creates that role.

XI.Intellectual property

Lucent's intellectual property.

Lucent, the Lucent name and marks, the Lucent Residency program, the Platform, and all content on the Platform are owned by Lucent or its licensors and are protected by intellectual property law.

You receive a limited, non-exclusive, revocable license to use the Platform for its intended purpose. You may not copy, modify, distribute, scrape, frame, reverse-engineer, or use the Platform or its content to train any machine learning model, except with our prior written permission. Unauthorized use is grounds for termination and may be pursued in court regardless of §XV.

XII.Disclaimers

Disclaimers.

THE PLATFORM AND ANY STAY ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, Lucent disclaims all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Platform will be uninterrupted, error-free, or secure. Lucent does not warrant that any Property will meet a Member's particular expectations beyond what the Residency Agreement explicitly states.

XVII.Termination

Termination & suspension.

Lucent may suspend or terminate your access to the Platform, your Membership, or any in-progress Stay at any time, with or without notice, for any breach of these Terms or for any other reason in its sole discretion permitted by law.

Sections IV, VII, IX, XI, XII, XIII, XIV, XV, and XIX survive termination, along with any other provision that by its nature should survive.

XVIII.Changes

When these Terms change.

We may update these Terms. Material changes are effective fourteen (14) days after the new effective date is posted on this page. Continued use of Lucent after that date constitutes acceptance. If you do not agree to a change, your remedy is to stop using Lucent and, where applicable, to cancel any not-yet-commenced Stay under its Residency Agreement.

XIX.Miscellaneous

The other necessary provisions.

  • Severability. If any provision is found unenforceable, the rest survive — except as stated in §XV regarding the class waiver.
  • Assignment. You may not assign these Terms or any rights under them. Lucent may assign these Terms to an affiliate or successor without notice.
  • No waiver.Lucent's failure to enforce any provision is not a waiver of that provision or any other.
  • Entire agreement. These Terms, the Privacy Notice, and any Residency or partner agreement form the entire agreement between you and Lucent and supersede all prior understandings on the subject matter.
  • Notices. Notices to Lucent must be sent to legal@lucentpropertygroup.com and to our registered agent of record. Notices to you may be sent to the email address on file.
  • Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control.
  • No agency. No partnership, joint venture, employment, or agency relationship is created between you and Lucent by these Terms.
  • Headings. Section headings are for convenience and do not affect interpretation.
